End User License Agreement

This End User License Agreement ("Agreement") is between you and Refractored LLC ("Refractored") and governs your use of the Tiny Clips application for Windows and macOS, including any updates provided by Refractored (collectively, the "Application"). By installing or using the Application, you agree to this Agreement. If you do not agree, do not install or use the Application.
If you obtained the Application from the Microsoft Store or the Mac App Store, the terms of that store also apply to your purchase and download; where those terms conflict with this Agreement regarding the store's own services, the store terms control. The Application's source code is separately available under the MIT License on GitHub; that license governs the source code, and this Agreement governs the packaged Application.
1. Scope of License
Subject to this Agreement, Refractored grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on Windows and Apple devices that you own or control for your personal or internal business purposes. You may make one backup copy solely for archival or recovery purposes. This Agreement also applies to updates that replace or supplement the Application unless an update is accompanied by separate terms.
You may not sell, rent, lease, sublicense, distribute, or make the Application available for use by others without Refractored's written permission. You may not copy the Application except as expressly permitted above, circumvent technical protections, reverse engineer, decompile, disassemble, modify, or create derivative works from the Application. These restrictions apply only to the extent permitted by applicable law and do not limit rights granted under the license terms of any open-source components included with the Application. The Application is licensed, not sold, and Refractored and its licensors retain all rights not expressly granted to you.
2. Data Use
The Application processes your captures and settings locally on your device. Refractored does not collect, store, transmit, or share your personal information or captured media through the Application. Details about the Application's data practices are provided in the Privacy Policy. Services you choose to access outside the Application, including download, update, support, or linked third-party services, may process information under their own terms and privacy policies.
3. Termination
This Agreement remains effective until terminated. You may terminate it at any time by uninstalling the Application and deleting all copies in your possession or control. Your rights under this Agreement terminate automatically if you materially fail to comply with its terms. Upon termination, you must stop using and delete all copies of the Application. Provisions that by their nature should survive termination will remain in effect.
4. External Services
The Application may provide links to or interoperate with third-party websites, software, or services ("External Services"). Your use of External Services is at your own risk and may be subject to separate terms. Refractored does not control, endorse, or assume responsibility for the availability, security, accuracy, content, or practices of External Services.
You may not use the Application or External Services to violate applicable law, infringe the rights of Refractored or any third party, or harass, abuse, threaten, or harm any person or entity. Refractored may change, suspend, or discontinue Application features that depend on External Services when reasonably necessary, without liability to the extent permitted by law.
5. Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION AND ANY RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. REFRACTORED DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. REFRACTORED DOES NOT WARRANT THAT THE APPLICATION WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION OR ERROR, OR PRESERVE ANY CAPTURE OR OTHER DATA. YOU ARE RESPONSIBLE FOR BACKING UP IMPORTANT FILES. NO ORAL OR WRITTEN INFORMATION OR ADVICE CREATES A WARRANTY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS OR LIMITATIONS ON CONSUMER RIGHTS, SO SOME OR ALL OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REFRACTORED AND ITS LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATED TO THE APPLICATION OR THIS AGREEMENT, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY EXCLUSIONS, SO SOME OR ALL OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
To the maximum extent permitted by applicable law, Refractored's total aggregate liability for all claims arising out of or related to the Application or this Agreement will not exceed the greater of the amount you paid for the Application or fifty U.S. dollars (US $50). These limitations apply even if a remedy fails of its essential purpose and do not limit liability that cannot legally be excluded or limited.
7. Export Compliance
You must comply with all applicable export control, sanctions, and import laws and regulations. You may not export, re-export, transfer, or use the Application where prohibited by United States law or the laws of the jurisdiction in which you obtained it, including to embargoed destinations or restricted persons. By using the Application, you represent that you are not prohibited from receiving it under applicable law and will not use it for any prohibited end use.
8. U.S. Government Users
The Application and related documentation are "Commercial Products," "Commercial Computer Software," and "Commercial Computer Software Documentation," as applicable, under 48 C.F.R. §2.101, §12.212, and §227.7202. U.S. Government users acquire the Application only with the same rights granted to all other users under this Agreement. All unpublished rights are reserved under the copyright laws of the United States.
9. Governing Law
This Agreement is governed by the laws of the State of Washington, excluding its conflict-of-law rules. Subject to any mandatory rights available to you under applicable law, the state and federal courts located in King County, Washington will have exclusive jurisdiction over disputes arising out of or related to this Agreement, and you and Refractored consent to their jurisdiction.
If you are a consumer in a jurisdiction whose laws require a different governing law or forum, those mandatory laws apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
